Terms of service: Customers

Welcome to NAICC (“Platform”). By accessing or using our Platform or participating in NAICC Hackathons or Solution Sprints, you agree to comply with and be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, please do not use our Platform and contact us to discuss alternatives.

1. Acceptance of Terms and Privacy Policy

By using our Platform or utilizing NAICC services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms form a legally binding agreement between you and NAICC Oy (“Company”).

2. Customer Participation & Responsibilities

2.1. To engage with NAICC and participate in hackathons or solution sprints, you may be required to provide accurate business and project information.

2.2. Customers are expected to provide:

Company contact information and project point of contact
A clear challenge/problem description
Access to relevant data, systems, or APIs when necessary
Prompt feedback during collaboration phases

2.3. Customers agree to provide accurate and complete information and to respond in a timely manner to ensure progress and quality outcomes.

3. Purpose of Engagement

We collect customer information to:

Evaluate project suitability for NAICC programs
Match customer needs with appropriate experts
Deliver hackathon or solution sprint results
Communicate regarding service delivery and support

4. Customer Conduct

Customers agree to:

Use the Platform and services in compliance with applicable laws and regulations
Respect participating experts and other stakeholders
Provide necessary input to support project completion
Maintain confidentiality of expert information and insights where applicable

Customers are responsible for protecting their proprietary information and determining whether internal NDAs or compliance restrictions affect their participation.

5. Intellectual Property

Unless otherwise agreed in writing:

NAICC retains rights to its platform, tools, processes, and evaluation models
Customers retain ownership of their proprietary data and problem statements
Rights to outputs, prototypes, and concepts from hackathons/solution sprints will be defined in a separate agreement or statement of work

No intellectual property is transferred without a written agreement.

6. Payment & Participation Terms

Service fees, payment terms, and deliverables will be agreed separately (e.g., proposal, invoice, or contract)
Failure to pay may result in service suspension or termination
Hackathon/solution sprint participation is subject to availability and approval

7. Termination

The Company may suspend or terminate access to the Platform or services if:

The customer violates these Terms
Payment obligations are not met
Conduct negatively impacts experts or NAICC operations

8. Changes to Terms

The Company may update these Terms at any time. Updates will be posted on the Platform, and continued use constitutes acceptance of the updated terms.

Terms of service: Experts

These Terms of service are for experts joining NAICC community. 
Each Hackathon you participate will have a separate non disclosure agreement and contract.
These contracts will be delivered for review before said hackathon.

1. Acceptance of Terms and Privacy Policy

By accessing or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and the Privacy Policy. These Terms and the Privacy Policy constitute a legally binding agreement between you and NAICC Oy (“Company”).

2. Registration and Data Collection

2.1. In order to be accepted into the platform and join NAICC Hackathons, you must complete the Expert questionnaire. You agree to provide accurate, current, and complete information during the registration process.

2.2. The Platform collects the following data from experts:

Email address for the purpose of checking experts’ profiles on platforms like LinkedIn, GitHub, Stack Overflow, etc.
Phone number for contacting the expert in case they are suited for a hackathon.
Name.
Experience in years.
Description of skills in various forms to your skills and to train our evaluation model.

3. Purpose of Data Collection

The data collected is used to identify and contact experts who may be suited for upcoming hackathons that aim to solve customer needs and to evaluate skills.

4. User Conduct

You agree to use the Platform in compliance with all applicable laws and regulations. You agree not to engage in any activity that could harm, disrupt, or interfere with the functioning of the Platform or with the activities of other users. You are responsible to know of possible Non-Disclosure agreements and Non-compete agreements that might not allow you to participate in certain hackathons.

5. Intellectual Property

All content and materials on the Platform are owned by the Company and protected by applicable copyright and other intellectual property laws. You may not use, reproduce, modify, distribute, or create derivative works of the content and materials on the Platform without the Company’s prior written consent.

6. Termination

The Company reserves the right to suspend or terminate your access to the Platform at its sole discretion, without notice, if you violate these Terms or engage in any conduct that the Company deems harmful to the Platform or other users.

7. Changes to Terms

The Company reserves the right to update or modify these Terms at any time. Any changes will be posted on the Platform, and it is your responsibility to review these Terms periodically.

For certain client projects, NAICC may act as a Data Processor if handling customer-provided data under a separate processing agreement.

8. Data Subject Rights

Under GDPR, you have the right to:

Correct inaccurate data

Withdraw consent at any time (e.g., marketing)

9. Data Processors

NAICC uses trusted vendors for hosting, communication, evaluation tools, and analytics. All vendors comply with GDPR and sign appropriate data processing agreements.

A list of sub-processors is available upon request.

10. Data Breach Procedures

In the event of a data breach affecting personal data, NAICC will:

Assess and contain the incident
Notify the Data Protection Authority within 72 hours if required
Inform affected users without undue delay
Take appropriate remediation actions

11. Changes to This Policy

NAICC may update this GDPR policy when necessary. Updates will be posted on our website and Platform.
